Simple terms explainer: 

For certain looked after 2‑year‑olds, local authorities may disapply the duty to provide funded early learning and childcare (ELC). This discretion applies where an assessment has been carried out and the council considers that alternative arrangements would better safeguard or promote the child’s wellbeing. Any decision must be made on a case‑by‑case basis, within the statutory framework, and subject to safeguards around parental objection.
