Simple terms explainer: 

Local authorities must provide appropriate care, whether on a regular or non‑regular basis, for children in need who are under the age of 5 and not yet attending school. This is a statutory duty aimed at safeguarding and promoting the wellbeing of young children who require support. In addition, local authorities have a discretionary power to provide care for children under the age of 5 who are not assessed as being in need, where they consider it appropriate to do so.
