Simple terms explainer:
Councils can pursue and serve penalty notices for refuse abatement and controlled waste. When a statutory nuisance—such as the accumulation of waste—is identified or likely to occur, the council is required to serve an abatement notice on the responsible party. Failure to comply can result in prosecution, fines, and further enforcement actions, including the recovery of costs for remedial work.
