Councils are required to oversee the legal process for private roads becoming public roads and to act where public safety is at risk. They must assess applications to adopt private roads and, where the required standards and legal conditions are met, add them to the list of public roads so they are maintained at public expense. Even where roads remain private, councils have powers and responsibilities to intervene if a private road poses a danger, for example by requiring safety works or carrying out emergency repairs to protect the public.
