Local authorities must enforce legislation relating to tobacco and nicotine vapour product banning orders and, where appropriate, apply to the Sheriff Court for an order restricting a retailer from selling these products. This includes cases where a retailer persistently sells to persons under the age of 18, fails to display compliant statutory signage, does not operate an appropriate age‑verification policy, or commits other related offences. Where a retailer is a repeat offender, Trading Standards Officers have the power to seek a banning order which restricts the sale of tobacco and nicotine vapour products from the premises.
