Local authorities must enforce criminal offences relating to the misuse of registered trade marks, including logos, brand names, symbols, and protected packaging. Trading Standards Officers, acting as local authority Weights and Measures Authorities, have powers to visit trade premises, inspect goods offered for sale or held in storage, carry out test purchases, and seize suspected counterfeit or infringing items. Where breaches are identified, councils may report traders and submit cases recommending prosecution.
